Feb 1 - Industry Won't Sue Santa Monica for Bag Ban
As we noted last week, the Santa Monica City Council voted unamniously to ban plastic bags. Now it looks like Santa Monica's careful approach will withstand the legal scrutiny that has derailed similar efforts in Manhattan Beach and Oakland.
According to a report in the Santa Monica Mirror, industry group Save the Plastic Bag Coalition is satisfied with the results of the City's EIR and won't be pursuing legal action to stop the ordinance from going into effect.
The industry group had filed suit in previous cases claiming Plastic Bag Ordiances to be "Projects" under CEQA. And while CAW disagrees with this claim, some municipalitites have gone ahead with the environmental assessment that would satisfy CEQA as Santa Monica has done.
